Stage1 - Trade Mark Search
It is always advisable to have a full clearance search conducted before making an application or using such mark in trade to ascertain the existence or prior use of any substantially identical or deceptively similar mark. In order to ensure this, a search can be conducted by us to ascertain the existence of any conflicting mark.
Stage2 - Trade Mark application
After a thorough search is completed, a Trade Mark application can be filed with the Trade Marks Registry in the statutory form and on payment of statutory fees. The Trademark application form will be provided by us.
Stage3 - Prosecution of the Application
After the application has been submitted, the Registrar allots an official number to the application. Thereafter, the application is taken up for examination and an Examination Report is issued stating objections, if any, by the Registrar. The Registrar communicates his objections, if any, directly to you or to us. You can hire the services of our Attorney at this stage.
Stage4 - Advertisement of the Trade Mark
After the submissions are made in reply to the Examination Report or after a hearing, the Registrar may accept the application absolutely or subject to such amendment, modification, condition or limitation as the Registrar may think fit. If the application is accepted, the Registrar shall cause the trademark to be advertised in the Trade Marks Journal absolutely or with conditions.
Stage5 - Opposition Period
After the advertisement of the trademark in the Trade Marks Journal, any person may oppose to the registration within 3 months which can be extended by one month from the date on which the Trade Mark Journal is made available to the public.
Stage6 - Trade Mark Grant
Generally, the entire procedure of registration of a trademark takes about 1-2 years from the date of the application provided the application is unopposed at the prosecution stage. If the Trademark application is not opposed, the registration shall be granted and a certificate of registration shall be issued by the Trade Marks Registry. You can start using ®
